You mean Delaware law says the gov can appoint the relacing senator when a seat becomes vacant before the term is up. In some states a special election is done. Other states are like Delware. Depends on the state.

Because that would be very expensive and not necessary. The law clearly gives the Governor the duty of appointing a new Senator when the office becomes vacant.
